Terms of Service & Clinical Disclaimer

1. Acceptance of Terms

By downloading, installing, accessing, or using the Ayuhand mobile application or website ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using the Platform and uninstall the mobile application.

3. Patient Data Ownership & Custody

You retain 100% ownership and intellectual property rights in and to all health reports, OPD booklets, laboratory results, prescriptions, and personal health data you store in Ayuhand.

• Ayuhand claims no ownership rights over your personal health records.
• We will never sell, lease, monetize, or disclose your health data to third-party advertisers or insurance underwriters.
• We will never train artificial intelligence or machine learning models on identifiable patient records.

4. User Account & Security Obligations

To protect the confidentiality of your health records, you agree to:

• Provide accurate identity information (Name, Age, Mobile Number) for your primary account.
• Maintain the confidentiality of your Security PIN, device lock credentials, and OTP verification codes.
• Immediately report any unauthorized access to your account or Doctor QR Pass sessions to support@ayuhand.com.

5. Doctor QR Pass & Clinician Sharing Rules

When utilizing the Doctor QR Pass feature:

• You acknowledge that sharing records with a healthcare professional constitutes your voluntary, explicit consent for that clinician to review the designated documents for up to 30 minutes.
• Ayuhand is not liable for clinical decisions or medical treatment rendered by clinicians who review documents through the QR Pass.
• You may terminate any active sharing session early by revoking the code inside the app.

6. Prohibited Activities

You agree not to:

• Upload false, forged, fraudulent, or defamatory medical records.
• Attempt to decompile, reverse-engineer, or disassemble the Ayuhand application code or bypass security sandboxing.
• Impersonate licensed doctors, medical institutions, or government health regulatory bodies.
• Use the Platform to store non-health-related unlawful content.

7. Limitation of Liability

To the maximum extent permitted by Nepal law, Ayuhand Health Tech Pvt. Ltd. and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the loss of device data, hardware failure, unreadable document scans, or medical decisions made by third-party healthcare practitioners.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Nepal. Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kathmandu, Nepal.
